HIPAAClickAndComply.com (HCC) Privacy Statement

HIPAAClickAndComply.com, Inc (HCC) is committed to protecting your privacy. This HCC Privacy Statement applies to all products and services provided under the HCC brand as well as related consulting referrals from HCC to Brandt Information Services, Inc. (BISI).

Information about users and organizations is collected, used and disclosed as described in this Privacy Statement. HCC is a web site through which various products and services are provided to users for the purpose of helping them and the organizations they represent, comply with the Health Insurance Portability and Accountability Act (HIPAA).

Any HCC associates linked to or from this web site are not necessarily governed by this Statement and may or may not have their own privacy statements. Therefore HCC must refer all inquiries about their policies to these linked sites. HCC is not responsible for the privacy policies or other content on web sites outside of HCC.

What Personal and Corporate Information Does HCC Collect?
HCC collects personal and corporate information, such as e-mail and postal addresses, names and telephone numbers. Information collected by HCC may be combined with information obtained from the National Association of HIPAA Privacy Officers (NAHPO) and HCC Alliance Partners.

HCC also collects certain information about your computer hardware and software which may include: your IP address, browser type, domain name, access times and referring web site addresses for the purpose of performance management and determining the value of HCC services.

How Does HCC Use Your Personal and Corporate Information?
Operating HCC
HCC and its Alliance Partners collect and use your personal and corporate information to operate HCC, deliver the services you have requested and facilitate invoicing for those services. This includes using the information to customize the HCC services on behalf of HCC customers. Examples include inserting this information into custom documents provided to you by HCC, customizing HCC screens viewed by you and providing users with customer help desk contact information when they need help.

Contacting You
Contact information is periodically used to inform you about updated versions or features of HCC products and services, other products or services available from HCC and its parent company (Brandt Information Services, Inc.) and to provide information from NAHPO. HCC may also contact you to solicit your opinions regarding medical privacy issues, determine your satisfaction with current HCC products and services, or to assess your interest in potential new services that may be offered.

Web Site Performance and Marketability Monitoring
Information pertaining to your activities on the HCC web site is used by HCC for the operation of the HCC services, to maintain service quality, and to provide general statistics regarding use of HCC products and services. HCC keeps track of the pages our customers visit within the HCC site in order to determine which HCC products, services and marketing information are of interest. Information about the pages you visit is not used as a basis for contacting you unless you specifically provide contact information for that purpose.

Protected Health Information
Patient information held within the HCC privacy action tracking system is considered the exclusive property of the customer and will be protected in a manner consistent with HIPAA privacy requirements. As such, it will never be shared with third parties unless required under the law and will not be accessible by HCC or BISI staff unless doing so is necessary to perform their duties related to operation of the tracking system or serving the customer who owns the data. When this occurs, all of the provisions describe here and in the Privacy Statement bind HCC and BISI staff. Because day-to-day operational access to patient information is the right of the customer, the customer is responsible for safeguarding patient information using tools provided by HCC in a manner that is consistent with HIPAA requirements, state and local laws.

Third Parties
HCC does not sell, rent or lease its customer lists to third parties. However, HCC does share your purchasing and contact information with Alliance Partners who have specifically performed a role in marketing or selling HCC products and services to you. HCC does so for the purpose of verifying the role of Alliance Partners in your decision to buy HCC products and services, or to assist with product and service delivery and/or payment issues.

HCC occasionally hires other companies to provide limited services on our behalf, such as processing and delivery of mailings, providing customer support, processing transactions, marketing, selling, and developing HCC products and services. We will only provide those companies the information they need to deliver the service(s) for which they are hired. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose in accordance with this Privacy Statement as if they are a part of HCC.

Meeting Legal Requirements, Protecting HCC and its Customers
HCC may access and/or disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to (a) comply with the requirements of the law or legal process served on HCC, BISI or the site; (b) protect and defend the rights or property of HCC or BISI or (c) protect the personal safety of users of HCC, its web sites, or the public when required by exigent circumstances.

How Can You Control Your Personal and Corporate Information?
You and/or persons authorized by you, may view, edit or delete your personal and corporate information in the HCC database by using various administration screens provided by HCC.

There are some HCC products and services, including HCC Documents and Training that require sending out periodic e-mails informing you of technical service issues, updates, new features and news about HCC products and services. You will not be able to unsubscribe to these mailings, as they are considered a part of the service you have chosen.
Other e-mails regarding HCC products and services and/or NAHPO will allow you to stop the delivery in the future from HCC by following the specific instructions in the e-mail you receive. The instructions explain how to stop receiving such e-mails.

How Does HCC Secure Your Personal and Corporate Information?
HCC is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. For example, we store the personal and corporate information on computer systems with limited access in controlled facilities. We also protect web transactions containing such data with encryption, such as the Secure Socket Layer (SSL) protocol.

How Does HCC Handle Credit Card Information?
Although HCC facilitates credit card transactions, the HCC web site itself does not accept or store credit card numbers or expiration dates. This is achieved by using Verisign credit card transaction services, which delivers a secure screen directly to you during the step in the purchasing process where you are asked to input credit card information. No credit card numbers or expiration dates are passed back to HCC. However, HCC is provided with authorization numbers and product information by Verisign to confirm purchases and payment. How Does HIPAA Track and Comply Secure Protected Health Information?
When HCC transmits Protected Health Information (PHI) as a part of our HIPAA Track and Comply service (HTC) over the Internet, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol in a manner consistent with the HIPAA standards for protection of all Protected Health Information.

How Are Changes Made to this Statement?
When HCC posts changes to this Statement, the implementation date will be changed at the top of the latest version (of the Statement) next to the heading, "last updated". HCC encourages you to periodically review this Statement to be informed of how HCC is protecting your information.

How Do You Contact Us?
HCC welcomes your comments, questions or concerns regarding our Privacy Statement and welcomes complaints if you believe that HCC has not adhered to this Statement. Please contact HCC by e-mail (preferred), telephone, or postal mail.
